Alan R. Feuerstein, Esq., Partner

Mr. Feuerstein became fascinated with the law at a young age.  While a teenager, he worked for law firms in Buffalo New York as a “runner” and as a “process server.”  During his undergraduate studies at the State University of New York of Buffalo, Mr. Feuerstein founded the State University at Buffalo Student Legal Clinic.  While working with attorneys, he conducted student interviews prior to professional referrals. While at the University at Buffalo, Mr. Feuerstein was employed by the Erie County Bar Association Pre-Trial Services Agency as an Investigator, he became a Junior Confidential Law Clerk for the Honorable Joseph Mattina of the Erie County Court and he worked as a Clerk for the Law Firm of Martoche & Collesano.    After his college graduation, he was appointed as the Senior Supervisor for the Erie County Bar Association’s Pre-Trial Services Agency.

 During Mr. Feuerstein’s attendance at the University Of Toledo College Of Law, Mr. Feuerstein became a student law clerk to Honorable Nicholas J. Walinski, of the United States District Court for the Northern District of Ohio, and he also remained employed as a student Law Clerk in Buffalo, New York.  While employed with the Law Firm of Salvatore R. Martoche, Mr. Feuerstein handled the preparation of Briefs in the case of Leonhard v. The United States of America.
 
 The “Leonhard” story was later turned into the movie “Hide in Plain Sight.”  The Leonhard cases that were appealed to the United States Supreme Court upon petition for writs of Certiorari are the original “Witness Protection Program” cases. The actor James Caan portrayed Thomas S. Leonhard in the movie production.  Mr. Feuerstein also handled the intellectual property and contract law work for the novel “Hide in Plain Sight” and much of the legal work associated with the movie production.

 After his admission to practice law in the State of New York in 1978, Mr. Feuerstein became a partner in the law firm of Martoche & Feuerstein before forming his own practice in 1981.  For over thirty years, Mr. Feuerstein has been engaged as trial counsel and appellate counsel on behalf of clients throughout the State of New York, the Commonwealth of Puerto Rico, the Territories of the United States Virgin Islands, and in the States of Illinois, Michigan, Arizona, California, Florida and in Ohio.

Mr. Feuerstein is recognized as a Super Lawyer and enjoys a distinguished rating among his peers.

NOTEWORTHY ACHIEVEMENTS

After appealing Leonhard v. United States of America to the United States Supreme Court, Mr. Feuerstein continued handling complex and intricate litigation and in representing corporate and individual clients in business matters. For over three decades, Mr. Feuerstein has become well known in handling complex international and multijurisdictional cases, legal matters centering on gambling, gaming, and lottery law, legal claims in admiralty and maritime, personal injury, medical malpractice, commercial and trademark litigation, and contested estate and matrimonial proceedings.  Mr. Feuerstein has also acted as legal counsel to real estate development companies, insurance carriers as well as commercial and residential lenders.  Recently, Mr. Feuerstein has been engaged as trial counsel to prosecute claims under the Federal Civil Racketeering Statutes, the Fair Labor Standards Act, and the Lanham Act.

 In 2011, Mr. Feuerstein was certified as a Florida Supreme Court Mediator, and a Certified Mediator for the United States Virgin Islands through the American Mediation Institute. His past activity in representing corporate clients stretches from the United States and Canada, to Panama, Venezuela, South Africa, The Caribbean Islands of the British West Indies, The Territories of the U.S. Virgin Islands, The British Virgin Islands, The Commonwealth of Puerto Rico, as well as in Great Britain, The Netherlands, Italy, and Malta.

 On behalf of plaintiffs, Mr. Feuerstein has achieved settlements and verdicts in hundreds of cases including the following:

** Shih-Ho Trading Company v. Del Rain Corporation – State of New York Supreme Court County of Niagara, $5.1 Million.[Case No. 078641/1992]
** Virgin Islands Maritime Services v. Puerto Rico Maritime Shipping Authority – District Court of the Virgin Islands Division of St. Thomas and St. John, $2.9 Million. [Case No. 1992/226]
** Michael Lenchyshyn v. Pelko Electric, Inc. – New York State Supreme Court, Erie County - $7.3 Million.  [723 N.Y.S. 2d 285 (2001)]
** The Estate of Christian Hendricks v. Graciano Balardo as Trustee – Territorial Court of the Virgin Islands Division of St. Croix $2.65 Million [Civ. No, 380/2001]
** Wertheim-Brault v Terri and Airport Transport Services – United States District Court for the District of Puerto Rico $5.0 Million (D.P.R. 2005).

 In addition to the above plaintiff’s awards, Mr. Feuerstein has been hired to handle intricate portions of complex litigation.  In Houston Texas, Mr. Feuerstein handled the damage and economic loss presentation for the plaintiff resulting in an award of over $20 Million Dollars  (Derrick Mfg. Corp. v. Southwestern Wire Cloth; 152 F. 3d 944).

 During his career, Mr. Feuerstein has also represented defendants in Civil and in Criminal litigation.  In the case of In Sync Interactive Video v. A.G.S. Telecom Corp. that went to verdict after a two month trial in Los Angeles, California, the plaintiff’s claims for damages that exceeded One Billion Dollars were dismissed against Mr. Feuerstein’s clients resulting in a zero defense verdict.

 Mr. Feuerstein has also actively litigated Medical Malpractice claims, Bank Holding Act violations, Trademark Infringement and Lanham Act claims, and in 2011 achieved a mediated award of over $10 Million in a civil racketeering claim brought by Mr. Feuerstein on behalf of a family who resides on the Island of St. Thomas in the U.S. Virgin Islands.
